Unanimously acquitted in the court of appeals

The Agder Court of Appeals has unanimously acquitted Simrad Horten AS and two of its employees, and granted court costs for the court of first instance as well as for the court of appeals, a total of MNOK 16,6.

Scanmar AS appealed a judgment handed down by the Horten District Court in 2004, where Simrad and two of its employees were not found to be liable on any points. It was alleged that they had acted at variance with sound business practice pursuant to §§ 1 and 7 of the Marketing Control Act. Scanmar contended that Simrad and the two employees had unlawfully taken advantage of the claimant's know-how and other company secrets.

The Agder Court of Appeals upheld the decision handed down by the Horten District Court in 2004.
